1. About these Terms
Welcome to Otiumz. These Terms of Service ("Terms") explain the agreement between you and Otiumz, Inc., a Delaware corporation. In this document, "Otiumz", "we", "us" and "our" mean Otiumz, Inc. The Terms apply to the features you use on our website and mobile apps, which we call the "Services".
You accept these Terms when you agree to them during registration. Using the Services may also count as acceptance where the law allows it. If you use Otiumz for an organization, you need authority to agree on its behalf. If you do not agree to the Terms, please do not create an account or use the Services.
Our Privacy Policy explains how we handle personal information. Reading the Privacy Policy or downloading an updated copy does not, by itself, mean that you consent to optional uses of your personal information or accept new Terms of Service. A purchase or feature may have additional terms, which will be shown to you. Your rights under applicable law continue to apply.
2. Age and account eligibility
You need to be at least 13 to create an Otiumz account. You need to be at least 16 to use public messaging, and at least 18 to buy or receive in-app currency, receive creator earnings, or receive a payout. Other account and feature requirements still apply. Please use your actual birthday so we can apply the right age settings.
If you are not old enough to enter this agreement where you live, you need permission from a parent or legal guardian who can agree to these Terms. Please also check any additional age or eligibility requirements shown for a feature. Otiumz is not directed to children under 13.
3. Your account and Subaccounts
When you create an account, please provide accurate information and keep your contact details up to date. Your account can include different Subaccounts, such as public and private Subaccounts. Before posting or contacting someone, check which Subaccount you are using and who can see it.
Please keep your password, verification codes and account access secure. Do not use someone else’s credentials, impersonate another person, or sell or transfer an account without our permission. If you think someone has accessed your account without permission, contact support so we can help.
You are responsible for activity you authorize through your account. You are not responsible for losses caused by our failure to meet our legal obligations. We may ask you to verify information when protecting your account or investigating misuse.
4. Community Guidelines
We want Otiumz to be a welcoming place to connect and share. These Community Guidelines apply to posts, comments, messages, account and Subaccount names, user-defined IDs, bios, images, and other content or activity on Otiumz.
- Help keep people safe. Nudity, sexually explicit content, sexual exploitation, and any sexual content involving children are not allowed.
- Treat people with respect. Threats, harassment, hateful abuse, and attacks on people because of characteristics such as race, ethnicity, nationality, religion, disability, gender, or sexual orientation are not allowed.
- Keep graphic violence and content intended to shock or seriously distress others off Otiumz. Do not promote violence or illegal activity.
- Respect privacy. Do not publish someone else’s private information without a lawful basis, exploit another person, or encourage others to harm them.
- Be honest about who you are and what you offer. Do not impersonate others, operate scams, send spam, or use misleading account or Subaccount information.
- Share only material you have permission or a legal right to use. This applies to posting, sending, copying, and sharing other people’s work, names, logos, and other protected material.
- Respect the Services and other people’s accounts. Do not upload malware, bypass access controls, disrupt Otiumz, or use automated tools to collect data or access the Services in ways that violate these Terms or the law.
Political and war-related content is not eligible for promotion in the For You feed. This is a rule about recommendations; all content still needs to follow these Community Guidelines wherever it appears.
We may remove content that breaks these rules and limit the relevant features, such as commenting or public messaging. If a public name, user-defined ID, bio, or image is offensive or hateful, we may ask you to change it before using the affected public features again. Serious or repeated violations can lead to permanent feature restrictions or account suspension or termination.
If you encounter harmful behavior, please use the available reporting or blocking tools, or contact support. We may review a report together with related content and account information. These tools help us respond, but we cannot guarantee that every harmful interaction will be detected or prevented. If you think we made a mistake, contact support with enough information to identify the content or account so we can review your concern.
5. Your content and how we use it to provide Otiumz
You keep the rights you have in the text, photos, videos, audio, Subaccount or Dating profile material and other content you submit ("Your Content"). Please make sure you have the rights and permissions needed to share it and to let us use it as described below.
To provide the Services you use, you give Otiumz permission to host, store, copy, transmit, display and make technical changes to Your Content. This permission is worldwide and non-exclusive, meaning you can still use your content and allow others to use it. It is royalty-free, meaning we do not owe a license fee for these uses. Technical changes include resizing media, converting file formats and making content work on different devices. Our service providers may carry out these tasks for us.
We use this permission in line with the audience and product settings you choose. It includes showing the name, avatar or other credit you attach to your content. You keep ownership of Your Content. This permission does not give other users unrestricted rights to reuse it outside Otiumz.
After you delete content or close your account, this permission continues only where needed to finish deletion, keep records required by law, resolve disputes, protect security, or support copies that others lawfully received and kept. The Privacy Policy explains how we handle personal information. Please keep your own copies of anything important to you; Otiumz is not a guaranteed backup service.
6. Intellectual property and rights complaints
We respect intellectual property rights and ask everyone on Otiumz to do the same. Please do not post, send, or share content that infringes a copyright, trademark, or another person’s rights. Giving credit to a creator does not replace permission when permission is required. Uses permitted by law, including applicable copyright exceptions, remain allowed.
If you own the rights to material or are authorized to act for the owner, contact support to report suspected infringement. Please include:
- Your name, a contact email, and whether you are the rights holder or are acting for them.
- A description of the work, trademark, or other right you believe has been infringed, with a link or other evidence that helps us identify it.
- Links to the Otiumz content, or enough identifying details for us to find each item you are reporting.
- An explanation of the suspected infringement and any relevant permission, ownership, or authorization information.
Please make reports honestly and as accurately as you can. We may ask for more information to understand the claim, including whether the use is authorized or permitted by law. We may remove or limit access to infringing material. Serious or repeated infringement can lead to account suspension or termination, as appropriate.
If your content is affected and you believe there has been a mistake, contact support with the relevant notice or content details and explain any permission, ownership, or legal basis for your use. Procedures and rights provided by applicable law continue to apply.
Sending a rights complaint does not transfer ownership of the content to Otiumz or to the person making the complaint. The preceding section explains the limited permission you give us to provide the Services.
7. Otiumz software and third-party material
Otiumz and its licensors keep their rights in the software, designs, names, logos and other material we provide. These Terms let you install the app and use the Services for their intended purposes. They do not let you resell the Services, remove ownership or rights notices, or copy protected material beyond what these Terms or the law allow.
Some links and integrations take you to services run by other companies. Their terms and privacy notices apply to those services. Other users are responsible for their own content and behavior. A link or user post does not mean that Otiumz endorses it.
8. AI features
AI features can create suggestions, replies, media or other output using your prompts and the conversation context, Subaccount or Dating profile information or files selected for the feature. Please check what you are sending, especially if it includes personal or confidential information. Only submit material you have permission to use.
AI output can be wrong, incomplete or biased, and other users may receive similar output. AI is not a person, and its responses are not guaranteed to be true. It does not replace advice from a qualified medical, legal, financial or other professional. You are responsible for deciding whether and how to use or share it, so please review the output first.
The same Terms and feature rules apply when you use AI. Creating a persona or digital representation does not give you permission to impersonate someone or use their identity without consent. The Privacy Policy explains how AI features and their providers handle information.
9. Subscriptions and purchases
Paid features may include account plans, subscriptions, virtual items or access to creator content. Before buying, please review the price, currency, billing period, renewal terms, included features and any additional checkout terms. Limits and availability may differ by plan or store.
A purchase described as automatically renewing will renew as explained at checkout until you cancel through the service that bills you. For Apple or Google purchases, use that store’s subscription settings and refund process. Deleting the app or requesting account deletion does not cancel a store subscription.
Cancellation, refunds and subscription changes follow the purchase terms shown to you, the billing provider’s rules and your rights under applicable law. If you are unsure who bills you or need help with an Otiumz purchase, please contact support. These Terms do not take away cancellation, warranty or refund rights provided by law.
10. Virtual items and earnings
Diamonds are virtual credits for use within Otiumz. You can use them through the features available to you, such as rewarding Moment or comment creators, paying for creator subscriptions, or unlocking paid content. A reward does not give you ownership of the recipient’s content or a right to services they have not offered.
Buying Diamonds gives you a limited license to use those credits through Otiumz under these Terms. Diamonds are not money, cryptocurrency, or an investment. Please use only the purchase and spending features Otiumz provides; these Terms do not authorize selling or trading Diamonds outside Otiumz.
Other virtual items, such as Boosts or Super Likes, provide the feature or number of uses described in their purchase offer. They are separate from Diamonds and creator earnings, and buying them does not entitle you to a payout. Please check the offer for the item’s features and any limits on its use.
You need to be at least 18 to buy or receive Diamonds, receive creator earnings, or receive a payout. This includes receiving Diamond-funded rewards, creator-subscription payments, and payments for paid content. The account and feature eligibility rules elsewhere in these Terms still apply.
Before you buy or spend Diamonds, please check the quantity, price or Diamond cost, recipient, and any subscription or access period shown to you. Purchase prices can vary by store, currency, and package. Buying Diamonds does not itself create payout-eligible earnings.
Purchased Diamonds do not expire.
Your spendable Diamond balance and your creator earnings are separate. Eligible rewards and creator purchases can produce earnings after Otiumz’s platform share and any split between creators. For example, a comment reward may be shared with the creator of the related Moment. The amount credited to earnings can therefore be less than the number of Diamonds spent. The price someone pays to buy Diamonds is not a promise of the amount a creator will receive in a payout.
Creator subscriptions paid with Diamonds cover the period shown for that subscription. If you enable automatic renewal, the feature can deduct Diamonds for the next period. You can turn off future renewal through the subscription settings. Turning off renewal does not itself refund a period already purchased; the refund rules and your rights under applicable law still apply.
To receive a payout, you need to meet the 18+ requirement, complete the required identity verification, and add an eligible default payout method. Regular payouts are subject to the applicable minimum and maximum amounts and the payout provider’s requirements. The final-payment process below also covers balances below the usual payout minimum when an account closes. Payout-method details show the relevant service fees and any currency-conversion charges. These can reduce the amount you receive. Please check your earnings and payout information in the app; a displayed balance does not mean that a payment has already been sent.
Earnings may be held until the relevant paid period becomes payable, and payouts may need review before they are sent. Processing can also depend on the payout provider. Posting content or receiving a reward does not guarantee an immediate payout.
For Diamonds bought through Apple or Google, use that store’s refund process. If a purchase is refunded, the corresponding Diamonds are removed from your balance. If you have already spent them, this can leave a negative balance and limit further spending until your balance is sufficient. If the store reverses the refund, the corresponding balance adjustment is reversed as well. Contact support if a purchase, reward, or balance looks wrong. Your rights under applicable law still apply.
While your account is temporarily suspended, access to Diamond purchases, spending and earning features may be restricted. A temporary suspension does not, by itself, remove your existing Diamond balance or eligible unpaid earnings. Purchased Diamonds still do not expire. If access is restored, your remaining balance becomes available again, subject to any valid transaction adjustments described here.
We may temporarily hold affected payout amounts when reasonably necessary to investigate suspected fraud, unauthorized transactions, refunds, payment reversals or errors, verify payout eligibility, or meet a legal requirement. A hold does not mean that you lose those earnings. We will review the hold and release eligible amounts when the reason for it is resolved.
If a transaction is confirmed to be fraudulent, unauthorized, refunded, reversed by a payment provider, or credited in error, we may correct or reverse the Diamonds or earnings attributable to that transaction, as permitted by law. Other eligible earnings remain payable. A refund request or payment dispute alone does not establish fraud. We will not suspend or ban your account solely because you request a refund or dispute a charge in good faith.
We will explain a payout hold or balance adjustment when appropriate and legally permitted. Please contact support if you believe it is wrong, including if you cannot sign in to your account.
If you request account deletion, please review your Diamond balance first. Whether you choose to delete your account or we permanently close or ban it, unused Diamonds will no longer be available to use. Permanent closure or a ban does not itself entitle you to a refund or cash payment for those Diamonds. Your rights under applicable law and the relevant app store’s refund rules still apply.
If you delete your account, or we permanently close or ban it, eligible unpaid creator earnings remain payable. Please contact support to arrange a final payment, including if your balance is below the usual payout minimum. We do not cancel those earnings just because the account closes, is banned, or the balance is below that minimum. Other payout requirements, including age and identity verification, an eligible payment method, fees, and any necessary review, still apply. If your usual payout method cannot process the balance because of a provider limit, support will work with you on an available settlement option. Your rights under applicable law still apply.
11. Keeping Otiumz available and safe
We work to keep Otiumz available and may maintain, update or change its features. Interruptions and technical problems can still happen. We cannot promise uninterrupted service or that every feature will remain available indefinitely. Our obligations for paid services continue to apply.
We may limit content or account access when reasonably needed to address a breach of these Terms, unlawful activity, a security threat, harm to others, or a legal requirement. Where appropriate and allowed, we will explain the action and how to contact us. We may need to limit notice because of an urgent safety issue, a legal restriction or a risk to an investigation.
Depending on the circumstances, we may restrict specific features, temporarily suspend your account, or permanently ban it. A permanent account ban ends your access to the Services through that account. The Virtual Items section explains what happens to Diamonds and earnings during suspension or after a permanent ban or closure.
If you think we made a mistake, please contact support with enough information to identify the account or content. While an account is suspended or permanently banned, please do not create or use another account to get around the restriction.
12. Closing your account
You can request account deletion in the app’s account settings or through the help page below. We may ask you to verify that the account belongs to you. The Privacy Policy explains the waiting period, what we delete and the limited information we may need to keep. Account deletion does not immediately remove every copy of your information or cancel store subscriptions.
A suspension or ban restricts account access; it does not mean that all account information has been deleted. If you cannot access account settings, you can contact support to request deletion or exercise your privacy rights. The deletion process and retention rules in our Privacy Policy still apply.
You can stop using Otiumz at any time. Some parts of these Terms still apply after you leave where needed to address earlier activity. These include amounts already owed, intellectual property rights, permitted retention of information and existing disputes.
Diamonds and earnings after account closure or a permanent ban
13. What you can expect from us
Please use care when relying on content, contacting other users or making decisions through Otiumz. We cannot guarantee that user content or AI output is accurate, that another person is who they say they are, or that information you share publicly will remain secure.
Where the law allows, we provide the Services as they are available, without guarantees beyond those expressly made in these Terms or for a purchase. Any warranties, remedies or responsibilities that cannot legally be excluded still apply.
These Terms do not limit responsibility for fraud, deliberate misconduct or any other loss for which the law does not allow a limit. For other losses, applicable law determines each party’s responsibility.
14. Questions, disputes and consumer rights
If you have a concern, please contact support@otiumz.com. We would like the opportunity to help resolve it. You do not have to contact us before exercising a legal right, and doing so does not change any legal deadline.
You may take a dispute to court. These Terms do not require you to use private arbitration instead, or take away your right to bring or join a group lawsuit, such as a class or collective action, where the law allows one. The law determines which courts can hear the dispute and which legal rules apply. You keep the consumer protections and remedies that the law where you live does not allow you to give up.
If part of these Terms cannot be enforced, the rest continues to apply as far as the law allows. If we do not enforce a rule on one occasion, that does not prevent us from enforcing it later.
15. Changes and document versions
We may update these Terms when Otiumz or relevant requirements change. Each published version shows when it was published, when it takes effect and a summary of what changed. Earlier versions remain available to read.
If a change requires notice or your agreement under applicable law, we will provide that notice or ask for your agreement. Reading or automatically downloading a policy does not, by itself, mean that you accept a new agreement. Updates do not take away rights from earlier events where the law protects those rights.
